Procedure of Approximation of National Legislation with European Standards in Kosovo

This paper aims to analyze the procedure of approximating Kosovo’s national legislation with European Union standards, as mandated by the Stabilization and Association Agreement. The approximation process is essential for meeting the Copenhagen criteria— economic, political, and legal—which are prerequisites for EU integration. The Ministry of European Integration coordinates this process in collaboration with other ministries and agencies, based on national and international legal frameworks. Although legislative alignment with EU acquis has progressed significantly, challenges remain in the practical implementation of these laws. Obstacles include insufficient resources, lack of political prioritization, and widespread corruption, which hinder the rule of law and effective application of reforms. The Kosovo Progress Report highlights early-stage preparation for acquis implementation and emphasizes the need for robust enforcement, particularly in judicial reform and anti-corruption measures. Regarding minority rights, Kosovo guarantees their protection through constitutional provisions, international conventions, and specific legislation such as Law No. 03/L-047. Unlike general legislative approximation, minority rights legislation is better implemented in practice.
