Description

The legislation in force in the Republic of Kosovo provides a clear legal framework that regulates the procedures for issuing construction permits, verifying compliance with legal construction requirements and providing a certificate of occupancy. This framework aims to guarantee sustainable urban development and compliance with safety, environmental and property standards. These conditions serve as the basis for the preparation of construction documentation for each cadastral parcel and are determined through the zoning and land use classification process, in accordance with the Zoning Map of Kosovo. In cases where an urban regulatory plan is missing, the applicant may propose to the competent authority construction conditions, based on a radius of fifty (50) meters from the boundaries of the parcel for which a construction permit is requested. The application for a construction permit must include: a copy of the plan, the applicant's ownership certificate issued by the competent authorities, the administrative act establishing construction conditions (if required under Article 18 of the relevant law), three copies of the construction documentation prepared in accordance with the Construction Code, as well as an electronic copy. In the case of temporary construction facilities, a determination of the time period of their use is required. Also, for constructions that potentially affect the environment, an environmental impact assessment is required, in accordance with the provisions of the Law on Environmental Impact Assessment (LPN, Articles 18 and 20).
