Description
In Kosovo, protection of ownership is one of the most important and very sensitiveissues. During the political developments of the last decades, ownership as a legal institution and the right to ownership as a fundamental right have been the target and goal of various violations, from the period of its total infringement, in situations of its limitations, the taking of the right of ownership with and without compensation, up to new forms which determine the ways defined by law for acquisition and losing the right of ownership.Therefore, "protection of ownership according to applicable legislation in Kosovo" is a topic that deserves to be approached and referred to, because the provision of legal certainty to the holders of the ownership rights constitutesthe protection of fundamental rights guaranteed by the Constitution of the Republic of Kosovo and by international documents. As such, the right of ownership, the forms of acquisition, loss and especially the protection of the ownership rights and their treatment is necessary when considering the period that Kosovo is going through, the challenges for the creation of new legislation covering the ownership rights and in accordance with EU legislation.
